TX State Senate Committee Approves SB 1083
The Texas State Senate’s Business & Commerce Committee unanimously passed Senate Bill (SB) 1083 on Tuesday. SB 1083 would mandate insurance companies to:
- Require the use of the part, product, or repair process used by the OEM or distributor to repair the vehicle for cars owned for LESS than 36 months and new at the time of purchase (policy owner or third-party claimant can opt-out with written consent)
- Not limit the policy holder or third-party claimant from selecting the repair person or facility of their choice for cars owned for LESS than 36 months and new at the time of purchase
- Not limit the policy coverage based on brand, type, age, vendor, supplier, or condition of parts or products or the repair process for cars owned for MORE than 36 months
- Not require or request a repair person or facility to use a certain percentage of non-original equipment to repair a vehicle

The same legislation passed the Business & Commerce committee unanimously in 2021. It then passed the Senate by a vote of 26-5, but the House failed to take action on the bill before the end of the legislative session.Post content here.
